General Terms and Conditions (GTC) of Signal Computer GmbH
§ 1 Scope and Provider
1. These General Terms and Conditions apply to all orders that you place in the online shop of Signal Computer GmbH, Hainhäuser Weg 91, 30855 Hannover, Managing Director: Ehsan Aleali.
2. The range of goods in our online shop is aimed at buyers within the EU who are at least 18 years old.
3. Our deliveries, services and offers are made exclusively on the basis of these General Terms and Conditions. The General Terms and Conditions also apply to future business relationships unless expressly agreed otherwise.
4. The contract language is German. If translations of these Terms and Conditions are available, the German version shall prevail in the event of any discrepancies.
§ 2 Conclusion of Contract
1. The presentation of the goods in the online shop does not constitute a binding offer to conclude a purchase contract, but a non-binding invitation to order.
2. By clicking the "Buy now" button you are making a binding offer to purchase. A purchase contract is concluded when we accept your purchase offer by confirming or shipping the goods.
§ 3 Prices
All prices stated on the product pages are final prices in euros and include VAT and other price components. Any shipping costs that may apply are shown on the respective product page.
§ 4 Terms of payment and default
1. Payment can be made in advance, by credit card, direct debit, PayPal or instant bank transfer. Other payment methods may be available during the ordering process.
2. The invoice amount must be paid within 10 days of receiving the order confirmation. If you pay by direct debit, you will bear the costs of chargebacks that arise due to incorrect data you have provided.
3. If you fall behind on your payment, you are obliged to pay the statutory default interest. Additional reminder fees may be charged.
§ 5 Delivery and Retention of Title
1. Unless otherwise agreed, the goods will be delivered to the address you provided.
2. The goods remain our property until the purchase price has been paid in full.
3. If you are an entrepreneur, the following applies in addition: We reserve title to the goods until all claims arising from the current business relationship have been settled in full.
§ 6 Cancellation Policy
1. Consumers have the right to withdraw from the contract within fourteen days without giving any reason, provided that the goods have not been delivered digitally and have not yet been used.
2. The right of withdrawal expires for digital products as soon as the download or use has begun.
3. To exercise your right of withdrawal, you must send us a clear statement (e.g. letter or e-mail).
§ 7 License Agreements and Copyright
1. Signal Computer GmbH grants you a non-transferable license to use the Software on one device per license.
2. Any unauthorized copying, distribution or modification of the software is prohibited. Upon termination of the contract, all licenses must be returned or use must be discontinued.
§ 8 Warranty and Liability
1. The statutory warranty rights apply to consumers.
2. For entrepreneurs, the warranty period is one year. In the event of defects, we will repair or replace the goods at our discretion.
3. We are not liable for data loss, especially when using data recovery or hard drive software, unless this is due to gross negligence or intent.
§ 9 Data Protection
1. Signal Computer GmbH collects and processes personal data only within the framework of the legal provisions of the GDPR. Data is treated confidentially and only passed on to third parties for the purpose of fulfilling the contract.
2. Customers have the right to information about their stored data and to request its deletion at any time.
§ 10 Final Provisions
1. German law applies to all legal relationships. The exclusive place of jurisdiction for all disputes is Hanover.
2. Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
